Drafting, negotiation and registration of Collective Bargaining Agreements

We provide ongoing advice to Employers’ Associations from different sectors of the economy on labour law matters. We intervene in the negotiation of Collective Labour Agreements, representing them at the negotiating table.

We also assist these associations before the competent labour authority for the registration, deposit and publication of the Collective Bargaining Agreement.

Legal assistance in the Joint Committees for the interpretation and monitoring of Collective Bargaining Agreements

We assist Employers’ Associations in the Joint Interpretation and Monitoring Committees of Collective Bargaining Agreements. We advise on queries raised before these Committees in relation to the interpretation of the articles of the Collective Bargaining Agreement. We attend the meetings and act as Secretary of the Joint Committees.

Legal assistance to member companies and drafting of information circulars.

In order to keep our members up to date, we assist Employers’ Associations in the drafting of information circulars on new legislation, amendments and jurisprudential interpretations.

Advice on sectoral collective disputes before the SIMA

The Firm has mediators from the Interconfederal Mediation and Arbitration Service F.S.P. (SIMA-FSP) and regularly participates in mediations, acting as a “facilitator” in the search for a possible agreement between the parties to resolve the collective disputes raised.

Collective disputes over interpretation

We advise employers’ associations on collective disputes arising from disagreements over the interpretation or application of a collectively agreed rule, assisting them before the SIMA or, where appropriate, before the competent labour courts.

Collective Bargaining Agreements

We provide legal advice and assistance to Employers’ Associations in legal proceedings challenging Collective Bargaining Agreements.

Strike and lockout

We offer advice on strike situations and collective disputes, from the strategy to be followed when a strike is declared, to its resolution, through negotiation and mediation in the conflict.
